User Agreement

This User Agreement ("Agreement") is a contract between you and Listity.ca ("Listity", "we", "us"). By creating an account or using the service, you confirm that you have read, understood, and agree to be bound by this Agreement and by our Privacy Policy.
1. The Service
Listity is a web-based service for creating personal and shared lists, tracking time, and managing related information. Features may be added, changed, or removed at any time, with or without notice.
2. Eligibility
You must be at least 13 years old to use Listity. If you are between 13 and the age of majority where you live, you must have permission from a parent or legal guardian. By creating an account, you represent that you meet these requirements.
3. Your Account
You are responsible for the information you provide when signing up and for keeping it accurate. You are also responsible for maintaining the confidentiality of your password, your session, and any connected social accounts. You agree to notify us promptly if you suspect unauthorized access to your account.
We may suspend or terminate accounts that violate this Agreement, that appear abandoned, or that are linked to fraud, abuse, or security threats.
4. Acceptable Use
You agree not to:
- Use Listity for any unlawful purpose or in violation of applicable laws;
- Upload, share, or store content that is infringing, defamatory, hateful, harassing, obscene, or otherwise objectionable;
- Attempt to gain unauthorized access to the service, another user's account, or the underlying systems;
- Interfere with or disrupt the service, including by flooding, scraping, or reverse engineering it;
- Use the service to send spam, malware, or other unwanted content; or
- Resell or commercially exploit the service without our prior written consent.
5. Your Content
You retain ownership of the content you create in Listity. By storing content in the service, you grant Listity a limited, worldwide, royalty-free licence to host, store, back up, and display that content solely for the purpose of operating the service and delivering the features you use. Where you have explicitly shared a list or record with another user, that user can access the shared content according to the permissions you set.
You are solely responsible for your content and for ensuring you have the right to upload and share it.
6. Sharing
Listity allows you to share lists and related information with other users. Once you have shared content with another user, that user may be able to view, edit, or copy it depending on the permissions granted. You are responsible for what you share and with whom.
7. Third-Party Services
Listity integrates with Google, Meta (Facebook), Anthropic, and other third parties. Your use of those services is subject to their own terms and privacy policies, and Listity is not responsible for their conduct or availability.
8. Service Availability
We aim to keep Listity available and reliable, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable due to maintenance, upgrades, or circumstances beyond our control. We are not responsible for any loss resulting from such interruptions.
9. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will meet your requirements, that it will be secure or free of defects, or that the data you store will not be lost or corrupted. You are responsible for maintaining your own backups of important information.
10. Limitation of Liability
To the fullest extent permitted by law, Listity and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the service. Our total liability for any claim related to the service will not exceed CAD $50.
11. Termination
You may stop using Listity at any time and may request that your account be deleted by contacting us. We may suspend or terminate your access to the service if you violate this Agreement or if we discontinue the service. Sections of this Agreement that by their nature should survive termination will survive.
12. Changes to This Agreement
We may update this Agreement from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of Listity after changes means you accept the updated Agreement.
13. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising out of or related to this Agreement will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
